On November 10, 2013, USPlabs LLC announced the recall of some OxyElite Pro diet pill products. The Dallas-based company took action to recall the products in question after the Food and Drug Administration informed them that the products had been shown to be a possible cause of liver illness, and could possibly be adulterated.
USPlabs LLC elected to institute a voluntary recall on certain products from the OxyElite Pro Super Thermo capsules, OxyElite Pro Ultra-Intense Thermo capsules, and OxyElite Pro Super Thermo Powder lines after they were informed that the FDA could legally take action to force them to stop distributing the offending products if they did not take action themselves.
The Hawaii Department of Health wrote the FDA to inform them of a number of liver illnesses that had been linked to OxyElite Pro dietary supplement products in that state. According to the Hawaii report, there have been 27 confirmed cases of patients beginning to suffer from a liver illness after using an OxyElite Pro-branded dietary supplement. The reported cases included one death, while several other patients required a liver transplant. Similar liver illnesses have also been linked to OxyElite Pro products in other states.
According to the warning letter sent from the FDA to USPlabs LLC, the dietary supplements that have been linked to liver illnesses all included aegeline, a new dietary ingredient that has not been in use long enough to provide evidence of safety for human consumption.
The FDA announcement urged consumers to discontinue use of all dietary supplements branded with the OxyElite Pro name, including products that weren’t specifically named as part of the voluntary recall.
It’s always sobering to see a company’s negligence leading to products that put innocent consumers in danger, particularly when those products were marketed as providing health benefits. If you have consumed OxyElite Pro products in the past, and have any reason to believe the products may have been detrimental to your health, your first call should be to your health care practitioner. It is vital that you take this first step to determine if using the OxyElite Pro diet pills have put your health at risk.
Your second call should be to an experienced product recall attorney to make sure your rights are being protected. Until companies stop being negligent and begin considering the health of the people who consume their products, taking legal action may be the only option consumers have to protect themselves.
